Should we file for a marriage green card before we live together?
It depends on the plan to live together. Jim's view: filing while apart invites scrutiny, so the strongest case is filed once you share a home.

Can a parent's petition get an adult child a green card after overstaying?
Generally not. An overstay is forgiven only for immediate relatives of U.S. citizens: spouses, parents, and children under 21.

Can a K-1 petitioner stop working while the case is pending?
The petitioner must show they can support their fiancé(e), so an income gap usually means a joint sponsor.

EB-3 unskilled case pending for years after long F-1 study: why the delay?
Jim's view: years of study without a degree plus an unskilled job offer draws close USCIS scrutiny.

Can I travel with a pending I-751 divorce waiver and a past arrest?
Jim's advice is not to travel. Even a dismissed arrest can lead to secondary inspection on return.

Spouse denied F-2 visas and listed on my EB-2: can she visit on a B-2?
Unlikely. Being named on an immigrant petition shows immigrant intent; follow-to-join is the better path.

Spouse's I-130 pending since early 2025 while my I-485 is filed: what now?
Telling the NVC you are adjusting is fine. If nothing moves after a reasonable wait, mandamus is an option.

Can I expedite advance parole for a family emergency?
You can ask USCIS for an expedite and an in-person appointment.

Revoked I-130 and a pending VAWA case: what if I get an NTA?
Jim hasn't seen VAWA filers get NTAs. You would defend in court, though the VAWA backlog adds uncertainty.

Spouse became a citizen through a parent: what proof do I need for my N-400?
A passport alone may not be enough. You must prove each derivation requirement, so an N-600 first helps.

Facing the N-400 interview after a fraud waiver?
Prepare to disclose it. A waived issue is still answered "yes" on the N-400, and a lawyer helps.

Dropping out of F-1 school with a marriage green card pending: what risks?
Tell the school about the pending case. An unexplained SEVIS termination can lead to enforcement even with an I-485 pending.

I-751 after a breakup: extreme cruelty or a good-faith divorce waiver?
Jim's view: proving a real marriage is usually easier than proving abuse. File on your own with the divorce filing.

Should I file the I-751 on paper or online?
Either works, and online filing may soon be required for some forms.

Answered a status question wrong on my I-485: should I apply for citizenship?
It depends on what USCIS knew. Get your file through a FOIA and review it before filing.

What is a petitioner-only I-130 interview?
USCIS is using them more often. Bring strong marriage evidence and proof of support.

Can I argue my asylum EAD clock should restart after the case was dismissed?
Jim doesn't see a winning argument. Once a case is referred to court, the clock usually stops.
