Jamahl Kersey is a criminal defense attorney in San Diego, California. He has defended all kinds of criminal cases from petty theft up to high-profile homicide. He started his legal career as a file clerk while in college at San Diego State University.

I WISH you practiced in North Carolina. I was accused of false charges, I have PILES of evidence proving otherwise, have offered to MEET with the ADA and detective to answer any question they have and provide a defense discovery, and 2.5yrs later they still have not even looked at the case or agreed to meet. I finally had to bond out just to be able to try and work on my own case (at the great expense to my family) but they are ruining my life, the court appointed attorney agrees there was no crime, but what can I do?

I was the obvious victim of a domestic violence case (I had a gash above my eye and my boyfriend at the time did not have any real injuries. Apparently they saw a scratch on him that he might’ve gotten from the scuffle. He actually called for an ambulance for me and that’s how the police ended up involved.) I was arrested and then taken to the hospital for stitches and my hospital report says that I didn’t have any personal belongings with me and that I was subject to blunt force trauma in the head and that I was not on any illegal substances. The police grabbed some items from the apartment that my former boyfriend lived in, we didn’t live together and that was my second time to see him in eight months, so I have not been there. After I was forced into the hospital, I was then booked in jail, and I saw that they were going through some belongings and they found in a illegal substance in the pocket of one of the items. I was surprised to find out, they were charging me with what they found because I had not seen it before. My former boyfriend used to buy auctioned off Storage units and he had a pile of things he was sorting through or so he said. Only know from what he said. The district attorney was unable to pursue domestic violence charges, so I was not indicted on that charge. They did, however, continue to charge me with possession of a substance and my public attorney because I couldn’t afford to hire one did not do discovery and when I tried to tell him what really happened? He said he didn’t wanna hear it and that the truth wouldn’t help me those are exact words. I also faced threats from my former boyfriend about implicating him in any kind of crime so between the public defender and him I didn’t know what to do other than take a plea for deferred adjudication two years probation. Well, July is supposed to be my ending date of my probation, but my probation officer has made things much more difficult for me than needed. Without going into detail, I’m facing a mandatory rehab stay and I don’t have the money to pay my bills without going to work, so I’m going to lose my car, my apartment, my belongings, and all I have left in this world that I love are my two cats, and I don’t know what to do because I just don’t have the resources. My former boyfriend passed away October 20 24 and although he was abusive at times he was financially helpful during my probation in which community service and constant meetings have impeded my ability to work a regular job and I’ve had to take on contract work That is more flexible. I was researching if there’s anyway for me to be able to withdraw my plea or change my outcome because going to inpatient rehab or being incarcerated is going to take away everything and I don’t have a criminal record. I’m 43 years old. I’ve worked very professional jobs and I’ve even been a paralegal at a family law office. I’m so ashamed that I haven’t consulted with any of the attorneys I know from school or from working because they all have a positive idea of me and I don’t want to muddle that. I am looking to see if there are any pro bono or civil rights lawyers that might help but here in Texas I don’t think that there’s a plethora of options anyhow, the point of me saying all of this, do you think that my fourth amendment right was violated when I was Seized? I know that you didn’t see the evidence or know the other side of the story but I’m telling it as objectively as possible. There was no reason to believe that I committed a crime because the person who did commit the crime called for an ambulance and he never was charged.I still have messages on my phone of the threats he made for me to take the plea and it’s just a lot I don’t really know how to sort through it, but I don’t think that I’m being treated fairly at all and I don’t think this is justice.

I'm not surprised to see so many defense lawyer videos appearing on You Tube. The US legal system is all about the money and shockingly little about the truth. That means the better a lawyer is at enabling guilty clients to go free the more money will be made. You Tube is just another marketing channel. Do when a prosecuting district attorney prevents you from using the information in your discovery. I.e., they have locked the information onto a thumb drive, so it cannot be removed for processing.
In the main a good defense lawyer will pretty much beat a prosecutor during trial. Prosecutors have little trial experience they rely on plea bargains to scare people with a lack of resources to plea out and not face extra time, even if innocent. This is when prosecutors will start doing illegal sheet like withholding evidence, etc. I knew for example, that OJ would be acquitted. The first time I heard the black prosecutor I thought what a dufus.
you cannot charge someone with a crime who has never had physical content with said person... hearsay leads to speculation, and I reiterate the facts based on "hearsay" and it would be deemed a violation of the defendants rights and reasons that no jury would convict over. First amendment is a right not a privilege. Neither you or I, or the judge have time to speculate over the matter.

My prosecutor and atty hid civil rights violations from me for 20 months.
